18. SMS / text messaging
Nilly Design Inc. DBA Zinodeck sends text messages (SMS) only to people who ask us to. This section explains how we collect mobile numbers for text messaging, what we send, how you stop the messages, and what we do — and do not do — with mobile information. It sits alongside the rest of this policy: your mobile number is personal information, so the retention rules in Section 9, the PIPEDA rights in Section 10, and the Quebec Law 25 rights in Section 11 all apply to it.

18.1 How we collect your mobile number
For text messaging, we collect mobile numbers in one way: you type your number into a form on this website and tick a text-message consent box before you submit it. The forms that offer SMS consent are our project inquiry form (zinodeck.com/contact-us) and our quote request form (zinodeck.com/get-a-quote). We collect phone numbers in other places too — see Section 3 — but a number given anywhere else is never enrolled in text messaging.
- The boxes are never pre-ticked. Nothing is recorded unless you tick a box yourself and submit the form.
- There are two separate boxes — one for non-marketing (transactional) texts, one for marketing texts. You can tick one, both, or neither, and each is a separate consent you can withdraw on its own.
- Consent is never a condition. Ticking a box is not required to request a quote, order a sample, use the calculator, download a brochure or Tarifa document, or apply to become a dealer. If you leave both boxes unticked, we will simply reply by email or phone instead.
- You can read the terms first. Links to this Privacy Policy and to our Terms of Service appear directly beneath the consent boxes.
- You must be 18 or older (or the age of majority where you live) to consent to receive text messages from us — see Section 14.
We do not buy, rent, append, or import mobile numbers from data brokers, purchased lists, or referral partners, and we do not text a number that reached us any other way — including a number already in our records from an earlier inquiry, a phone call, a sample order, or an advertising lead form. Giving us a phone number on a form without ticking a consent box is not consent to be texted — we will use that number to call you back about your inquiry, and nothing else.
18.2 What we send, and how often
Depending on which box you ticked, we send:
- Non-marketing (transactional) texts. Replies to a project inquiry, calculator estimate, or quote request you submitted; sample-order confirmations and shipping or delivery updates; site-visit and call scheduling; and dealer-application status updates.
- Marketing texts. New colours and collections, promotions and seasonal offers, brochure and Tarifa releases, and dealer-program news and offers.
Message frequency may vary. Transactional texts are sent only when something is actually happening on your inquiry or order. Marketing texts are occasional — normally no more than four per month. Message and data rates may apply, depending on your mobile plan and carrier: we do not charge you for text messages, but your carrier may.
Text messages are delivered by mobile carriers over networks we do not control. Carriers are not liable for delayed or undelivered messages, and we cannot guarantee that every message will arrive.
18.3 How to stop, and how to get help
- To stop: reply STOP to any text message from us — STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT work the same way. STOP ends all text messages from us, marketing and non-marketing alike. You will receive one final message confirming that you have been unsubscribed, and we will not text you again unless you opt in a second time.

Text and email are separate consents: replying STOP does not unsubscribe you from our emails, and unsubscribing from email does not stop texts. Stopping texts also does not cancel a quote, a sample order, or a dealer application already in progress — we will simply continue to reach you about those by email or phone.
18.4 How we share mobile information
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
In practice, and for text messaging only, your mobile number is handled by two of the providers listed in Section 7, both under contract and both acting only on our instructions: Webflow, which hosts this website and receives the form you submit it on, and GoHighLevel, our CRM and messaging platform, which is the subcontractor in support services that sends the message. Beyond those two, delivering a text means handing the message to regulated telecommunications carriers, which necessarily receive your number in order to route it to your handset. We do not control those networks and we do not give them your number for any other purpose.
Your mobile number is not shared with advertising platforms. The conversion measurement described in Section 7 uses page and event data, advertising click identifiers, and hashed email addresses; mobile numbers and SMS consent records are excluded from it. They are not sold, and not “shared” for cross-context behavioural advertising, under the CCPA disclosure in Section 13.
18.5 Your consent, CASL, and your rights
Under PIPEDA we rely on your express consent to text you — the tick-box described in 18.1 (see Section 5). A promotional text message is a commercial electronic message under CASL, so we hold marketing SMS to the same express-consent standard as marketing email: every marketing text identifies us and tells you how to opt out.
We keep a record of each consent — the date and time, the page it was given on, the exact wording of the box you ticked, and the number you gave us — so we can demonstrate consent if you or a regulator asks, and we keep it for as long as you remain opted in. If you opt out, we keep a suppression record — your mobile number and the fact that you opted out — for as long as we operate the text-messaging program, so that your opt-out continues to be honoured. This is the same mechanism as the marketing suppression list described in Section 9. Consent and suppression records are kept for compliance only and are never used for marketing.
You can withdraw consent at any time — in whole or for marketing only — by replying STOP, by emailing info@zinodeck.com with the subject line “SMS Request,” or by calling +1 647-558-0018. Every right in Section 10 — access, correction, withdrawal of consent, deletion, and complaint — applies to your mobile number and to your consent record. The single exception is the suppression record itself: if you ask us to delete your information, we will still keep your number on the do-not-text list, because erasing that record is the one thing that could cause us to text you again by mistake. Quebec residents have the additional rights set out in Section 11.
